Health rights are dealt with under constitutional law, with application of Law 8,080 / 90, Law 9,656 / 98, as well as civil and consumer law. This is a fundamental right that must be guaranteed by the State, as well as preserving the principles and rules in relation to health plans and insurance through ANS - National Supplementary Health Agency, linked to the Ministry of Health. It is through this branch of the right that it is possible to attack abusiveness in health insurance contracts, obtaining medicines and medical treatments through the State, ICU beds, among others.
